The UAE VAT Law defines the scheme as adjusting initially recovered input tax based on actual use during a specified period, with Article 60 providing the legal framework. The executive regulation supplies the detailed asset criteria and adjustment mechanics, so read both together, including current amendments.
The Ministry of Finance's September 2026 consolidated English text, marked 'not an official translation', incorporates Cabinet Decision No. 149 of 2026 and lists 1 October 2026 as its effective date.
Its amended Article 57(1) describes a business asset costing at least AED 5 million excluding tax, with an estimated useful life of at least ten years for a building or part and five years for other capital assets. Apply the amended definition only from its stated effective date, and read the enacted Arabic decision and applicable timing before a real filing.
The Ministry's translation also retains Article 57(3) on specified staged payments, so do not rely on a single summary phrase to decide whether separate spending qualifies. Useful life is a separate test from cost, since a high purchase price alone does not make a short-lived item eligible, and items of stock for resale are excluded by Article 57(2).
An expensive item used only briefly may not qualify. Analyse assets individually under the legal definition, and do not add unrelated small purchases simply to cross the threshold.
Record how the asset is used each year. A mixed-use building may house taxable commercial lettings and exempt residential activity, and changes in tenants or floor use can affect the recovery share, so choose a defensible method and retain floor plans, leases and calculations.
For a simple illustration, input VAT of AED 1 million on a qualifying building is divided across ten adjustment years, giving AED 100,000 per year. If the taxable-use share falls by 20 percentage points against the initial basis for one year, a simplified adjustment is AED 20,000 against the business.
An estimate unsupported by evidence is hard to defend, and actual calculations depend on the law's detailed timing and use rules.

Its original documented input VAT was AED 1 million. In one later adjustment year, space moved to a use that reduced the supported taxable-use share by 20 percentage points.
The tax team used AED 100,000 as an illustrative annual portion and modelled AED 20,000 less recoverable VAT for that year. It checked the property's actual classification and applicable regulation before filing. The case does not assert that every mixed-use building follows this simplified calculation.
