Notice Period

A notice period is the required amount of advance warning an employee or employer must give before ending an employment contract. It ensures a smooth transition of responsibilities, giving companies time to find replacements and staff time to secure new work.

What it means

In business operations, managing departures is just as important as hiring. A notice period is the legally agreed timeframe between when someone resigns, or is let go, and their final working day.

This duration is usually outlined in the employment contract and often scales with seniority or length of service, ranging from one week to several months. For non-finance managers, understanding notice periods matters because sudden departures disrupt team productivity and project momentum.

When a key team member leaves, the notice period provides a buffer to redistribute workload, complete handovers, and recruit a replacement without causing a sudden drop in operational output. Financially, notice periods also impact budgeting and cash flow.

If a departing employee receives pay in lieu of notice, meaning they leave immediately but get paid for the notice period instead, this creates an unexpected short-term expense. Conversely, a long notice period can delay the onboarding costs of a new hire if budget allocations are tightly bound to specific headcount limits.

In practice, managers must track these timeframes carefully to avoid staffing gaps. If a competitor hires your top salesperson, a three-month notice period protects your client relationships while you train a successor.

However, enforcing it requires clear communication and often some flexibility to keep workplace morale positive during the transition.

In practice

Real-world examples.

1

Example

TechStartup Ltd requires a four-week notice period for software developers. When lead developer Sarah resigns, this gives the team one month to document her code and transfer ongoing app updates.

2

Example

A local manufacturing SME enforces a three-month notice period for senior plant managers. This extended window ensures adequate time to recruit, vet, and train a replacement for safety compliance.

3

Example

An independent coffee shop uses a one-week notice period for baristas. Because the role requires less specialized training, a short window is sufficient to hire and train a replacement student.

Think of it

A notice period is like giving advance warning before moving out of a rented flat, giving the landlord time to find new tenants and giving you time to pack properly.

Formula

Calculation

Payment in Lieu of Notice (PILON) = Daily Rate multiplied by Remaining Notice Days. For example, if an employee earns 200 pounds per day and leaves immediately with 10 days of unworked notice, the calculation is 200 x 10 = 2,000 pounds payout.

Case study

Seen in the real world.

Greenfield Logistics, a medium-sized distribution firm, faced a sudden disruption when their operations director, Mark, resigned to join a competitor. Mark's contract specified a three-month notice period. Greenfield's managing director needed to decide whether Mark should work through those three months or leave immediately with a payout. Because Mark possessed sensitive strategic plans, the company decided on garden leave, paying his full salary for the three months while restricting him from accessing company systems. Simultaneously, Greenfield used the notice window to promote an internal manager, Sarah, and pair her with Mark for two weeks of intensive handover. This approach cost the business 15,000 pounds in salary during the transition month, but it prevented any delivery delays for their top clients. By respecting the notice period framework, Greenfield protected its operational continuity and successfully integrated Sarah into the director role without missing a single delivery deadline.

Watch out

Common mistakes.

  • Assuming notice periods are legally identical for all staff regardless of what is written in their individual employment contracts.
  • Ignoring the financial impact of paying out unused holiday accrued during the notice period.
  • Allowing departing staff to leave immediately without checking if they possess critical operational knowledge that requires a handover.

Questions

People also ask.

Can an employee leave immediately without working their notice?

Yes, if the employer agrees to waive the notice, or if the employer pays the employee in lieu of notice. Otherwise, leaving without permission can be a breach of contract.

Does annual leave continue to accrue during a notice period?

Yes, employees continue to build up holiday entitlement right up until their final official day of employment, which must be paid out if unused.

What is garden leave?

Garden leave is when an employee is told not to come to work during their notice period, but continues to receive full pay. This is often used to keep sensitive information safe when someone joins a competitor.
