Parental Leave

Parental leave is time away from work for a parent to care for a new child, under the rules of the relevant employment system. In the UAE private sector, either mother or father may take five paid working days within six months of a child's birth under the federal labour framework.

It is distinct from maternity leave, and other jurisdictions or employment regimes can differ.

What it means

Parental leave is a short paid absence that lets a parent care for a newborn and help the family settle. The UAE government's private-sector guidance states that both mothers and fathers may apply for five paid working days of parental leave between the child's birth and six months later, and the relevant federal labour law contains the underlying entitlement.

Check the worker's employment regime before applying it, because government employees and workers under special regimes may have different arrangements and the private-sector summary is not a universal answer for every workplace in the country. Five working days are not necessarily five consecutive calendar days, so HR should confirm which days count for the employee and record the dates used.

Part-time and non-standard schedules need careful handling, and the phrase "working days" should be applied to the actual arrangement under the relevant rules. The six-month window can support care after the immediate birth arrangements as well as in the first days, so the leave may be split rather than taken together.

A mother can have maternity leave under a separate provision, and parental leave should not be silently treated as part of the 60-day private-sector maternity entitlement. A father can use the same parental-leave entitlement, so eligibility should be communicated to both parents in the workforce.

Plan the two types properly and confirm timing when they overlap. Payroll should treat the statutory leave as paid under the UAE private-sector guidance, calculated using the applicable wage rules, and not mistake it for unpaid personal leave or annual leave.

HR should record each day taken and the balance remaining, and give the worker a clear confirmation, especially if the days are split. Other leave policies may be more generous, but a company should clearly distinguish contractual benefits from the statutory minimum.

Ask for any necessary evidence, such as birth information, through an approved channel, keep the birth date and chosen leave dates in the HR record, and let only authorised HR staff handle family documents. Agree the handover for the selected days by naming an alternate owner for urgent customers or approvals, and avoid scheduling pressure.

If a child is ill or needs additional care, another form of leave may apply under particular conditions, so review the correct provision and evidence. For a small company, prepare backup before any leave request arrives by cross-training key approvals and maintaining customer notes so one person's absence does not halt operations.

For a business owner, parental leave is a short, paid right with a defined window in the UAE private sector. Apply it to either parent, keep it distinct from maternity leave and plan coverage respectfully, because correct records make the process easy for everyone.

Worked example: a father takes 2 paid working days in the week after the birth and 1 more working day three months later. Days used = 2 + 1 = 3, so remaining parental days = 5 - 3 = 2, and he must use them within six months of the birth. If he takes the last 2 days in month five, the balance reaches 0 inside the window.

Case study

Seen in the real world.

This entirely fictional example concerns Meridian Foods, an invented UAE private-sector employer. A worker planned to take two days soon after his child's birth and three later. HR checked the six-month window, recorded the working days and arranged another supervisor for his customer approvals. Payroll marked the days as paid parental leave rather than annual leave. The manager received only the coverage dates, not the child's documents.

The case does not decide entitlement under a different employment regime. Afterwards Meridian added a one-page checklist to its HR process covering the window dates, the balance tracker and the backup owner. The next request, from a mother in the finance team, was handled in a single conversation. The checklist is an internal practice and not a legal requirement.
